INTRODUCTION

This document (along with any documents referred to herein) explains to you the terms and conditions upon which we sell and supply to you the goods and services detailed on our website.


Before confirming your order please:

Read through these terms and conditions and in particular our cancellations and returns policy and limitation of our liability and your indemnity. Print a copy for future reference.

Read our privacy policy regarding your personal information.

By ordering any of the Products listed on this Website, you agree to be legally bound by these Conditions. You will be unable to proceed with your purchase if you do not accept these terms and conditions as may be modified or amended and posted on this Website from time to time.

We reserve the right to revise and amend the Website, our disclaimers and the Conditions at any time without notice to you. Your continued use of the Website (or any part thereof) following a change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether we have changed these Conditions.

INFORMATION ON OUR WEBSITE

Whilst every effort is made to update the information contained on this website to make any representations or warranties, whether express, implied in law or residual, as to the sequence, accuracy, completeness or reliability of information, opinions, any share price information, research information, data and/or content contained on the website (including but not limited to any information which may be provided by any third party or data or content providers) (“information”) and shall not be bound in any manner by any information contained on the website. We reserve the right at any time to change or discontinue without notice, any aspect or feature of this website. No information shall be construed as advice and information is offered for information purposes only and is not intended for trading purposes.

OUR RIGHT TO VARY THESE TERMS

We have the right to revise and amend these Terms from time to time.

Where we are required to make changes to our policies, terms and conditions or other documents by law, you will be subject to those changes even if they are made after you have made your booking. Apart from that, your booking is made subject to the policies and terms and conditions in force at the time that your order for Services from us is accepted by us.

THIRD PARTY RIGHTS

A person who is not a party to a Contract has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of that Contract, but this does not affect any right or remedy of a third party which exists or is available apart from that Act.

TRADEMARKS

The trade marks, names, logos and service marks (collectively “trade marks”) displayed on this website are registered and unregistered trade marks of SunkissTravel and all associated third parties and affiliates. Nothing contained on this website should be construed as granting any license or right to use any trade mark without the prior written permission of SunkissTravel or associated third parties and affiliates.

EXTERNAL LINKS

External links may be provided for your convenience, but they are beyond the control of SunkissTravel and no representation is made as to their content. Use or reliance on any external links and the content thereon provided is at your own risk. When visiting external links you must refer to that external websites terms and conditions of use. No hypertext links shall be created from any website controlled by you or otherwise to this website without the express prior written permission of SunkissTravel or associates third parties and affiliates.

STATUS

By using our site and the Services, you warrant that:

You are legally capable of entering into binding contracts (i.e. you’re in a position to legally sign and agree to this contract and that you’re 17 year of age or older and are not suffering from a mental disability); and You will use our site only for the purpose of using and accessing Services.

SPECIFIC USE

You further agree not to use the website to send or post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, racially offensive, profane or violates any applicable law and you hereby indemnify SunkissTravel against any loss, liability, damage or expense of whatever nature which SunkissTravel or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website to send or post any such message or material.

TRAVEL ARRANGEMENTS / FLIGHTS

SunkissTravel are not liable for any travel arrangements or cost for your flight to your chosen summer resort. SunkissTravel will not be held liable for any changes/delays or cancellations to your flights.

The flight company who you booked with, should be contacted as your contract will be with them. If you need any assistance with delayed flights or cancellations you can contact a member of our team.

Flights home are also not the responsibility of SunkissTravel. Again we will assist in helping you book a flight if needed, but this is not paid for by us as a company and you should budget your final weeks in resort accordingly to allow for return flights and transfers.

PRICE GUARANTEE

Once booked, the price of your holiday is fully guaranteed and will not be subject to any surcharges. We reserve the right to revise prices for new bookings. The price that we confirm at the time of booking is the price you pay.

SERVICES NOT INCLUDED

Your flight, transfer, holiday insurance, personal expenses (food, drinks, laundry etc) and the Apartment/hotel deposit are not included in the price of your working holiday.

WORKING HOLIDAY BOOKING ARRANGEMENT / BOOKING DEPOSIT / REGISTRATION FEE

After you've expressed an initial interest in working abroad with SunkissTravel and we have accepted your application we will then need you to confirm that you're genuinely interested in working abroad by paying the registration fee/booking deposit of £88/€100.

On receiving these funds we will then send out your SunkissTravel Confirmation Letter. Inside you will have confirmation that you are now a fully registered worker for the forthcoming summer along with lots of information about your chosen resort and tips and hints on how to fully maximize your summer experience with us at SunkissTravel. Please note the booking deposit payment is non-refundable in all circumstances.

We will: Provide long-stay accommodation for you as specified when you make your booking and subject to these terms and conditions and assist you to find vacation work.

In return for our provision of the Services, you will pay to us the Fees, which are made up of a non-refundable Booking Deposit, which you will pay to us when you make your Booking, and the Balance, which is due no later than 8 weeks prior to the start of your working Holiday. We may also require you to pay a Breakages Deposit, which will be refunded to you on or shortly after your holiday ends on the assumption that there have been no damages to your room, subject to these Terms, and finally a Rep Fee of €50 to cover your Workers Discount Band and unlimited help and support from your reps.

These fees are all compulsory, and you will not be given access to your room until the Breakages Deposit and Rep Fee have been paid, these are both due in the resort.

You may cancel your booking at any time prior to the start of your Holiday, subject to the terms of our Cancellation Policy.

ACCOMMODATION BALANCE FEES

The Booking Deposit cannot be refunded in the event that you wish to cancel or change your Holiday. Each guest will be automatically set up on a monthly payment plan, your monthly payment amount is €50/£50 that will be automatically taken from your card each month.

Your full working holiday balance is due 8 weeks before your arrival date. If you do not want to be on a payment plan and wish to just pay off your own holiday in your own stages please let us know by emailing. This needs to be done 48 hours before your first payment so we can cancel your subscription amount, failure to do so may result in money been taken and charges been made by your bank. Once you have made the first payment on your payment plan, the payment schedule cannot be changed or altered without our agreement, failure to make your payments may result in your space been cancelled.

If you do not accept the terms of our monthly payment plan then a percentage of your remaining balance ( not including your deposit ) needs to be paid in three installments. ( See below ) Three Installments Remaining Balance Option

  • 25% FULL BALANCE DUE
  • 4 Weeks after your booking
  • 50% FULL BALANCE DUE
  • 8 Weeks after your booking
  • 100% FULL BALANCE DUE
  • is due 8 weeks before your arrival date

If you have booked your place within 8 weeks of traveling, your balance will need to be paid in full at the time of booking. If these payments are not made on time you risk losing your place with us. If you are having any problems making payments or you need extra time to make payments please get in touch with us by email.

ACCOMMODATION / APARTMENT DEPOSIT

Accommodation supplied by SunkissTravel is only for you and your selected roommates and may be subject to a small deposit.

If anyone, apart from your selected roommates are found in or proved to have resided in the accommodation without the knowledge or written consent of your representative, you will be asked to leave the accommodation without notice.

If you or any of your roommates damage the accommodation (or contents) or break any of the rules or regulations relating to the occupation of the apartment, you are required by the owner of the accommodation to leave. You then forfeit your right to reclaim your deposit.

If you deny a representative the right of entry, you will be immediately struck off the SunkissTravel database without further notice and will be required to leave the accommodation. The amount of time you spend in the accommodation is at the discretion of SunkissTravel, pending all rules and regulations are adhered to.

Any deposit will need to be reclaimed in your holiday resort.

Failure to reclaim in your destination will result in the loss of your deposit.

It is your responsibility to pay your deposit to the landlord/Apartment/Hotel reception and to no other person, including the representative. Only the landlord/Apartment/Hotel Reception can issue a receipt to prove payment.

SunkissTravel is not responsible if rent or deposit is paid to anyone else but the landlord/Apartment/Hotel Reception. You also understand that the accommodation is only available for the period set out in your confirmation letter and website.

The Property will be available for you from 4:00pm on the day on which you are due to arrive, your arrival date. On the day you are due to depart, you must vacate the Property by 11:00am. This means that you must remove all your luggage and items of your personal property. If you fail to do so, we may, at our discretion, charge you for an extra day’s accommodation. If your return flight (or other onward travel plans) is much later in the day, we may be able to arrange storage of your luggage but we cannot promise this as facilities vary from resort to resort. Stored luggage is left with us at your risk and you should make sure that any luggage that you leave with us is covered by your insurance just in case of loss or damage.

You will not have to pay gas and electricity consumed on or supplied to the Property during the Holiday.

SunkissTravel cannot predict how strict the hotel management will be with noise levels after dark so you should always ask your reps on arrival as to what noise levels are currently deemed acceptable. Those wanting quiet nights must be aware the apartments/hotels we use can be in lively hotel/apartment locations in the resorts we offer. Hotels have the right to remove persistent offenders so if you are warned please take this seriously as SunkissTravel will not be held responsible if you are evicted.

Most apartments will sleep 3/4 people, we also have apartments based 2/6 people, this will be with a mixture of beds and sofa beds in a mixture of studio , 1 bedroom and 2 bedroom apartments. If you are concerned about sleeping on a sofa bed please make our office aware of this when making your booking and we will try to secure a bed for you. The longer you leave this the harder it will be for us to make a bed available. Special arrangements cannot be made when you are in your chosen resort.

SunkissTravel group number can vary by departure dates and are normally between 5 to 10 people per group, SunkissTravel can change this number depending on the popularity of a resort and month.

If you feel a roommate is abusive, aggressive or disrespectful and you would like them removed from your apartment, please contact your rep in resort or get in contact with our office. If the complaint is brought to our attention after you have come home or move out, no further action may be taken.

WELCOME WEEK ACTIVITIES

A big part of the experience is your welcome introduction week where its all about having as much fun as possible an making new friends that will quickly turn into family when you arrive.

Expect a host of activities such as Beach Days, Bar Crawls, Meals Out, Club Nights, Pool parties, and Boat Parties. Whilst we always endeavor to make these events free, some small costs to cover areas such as all inclusive bars, meals, boat parties are not included in the price and will be subject to availability at the reps discretion. These events are however on a non profit basis and we promise to keep these down to the bare minimum. You will always be advised of any costs prior to the event so there are no hidden extras to be concerned over. We offer 12 resort locations, please note in resorts Marbella, Tenerife, Lanzarote and Sunny Beach we do not offer the party introduction.

INAPPROPRIATE BEHAVIOR

The ongoing relations with our partners, hoteliers, contractors, suppliers and most importantly our Workers is the upmost importance to us. If the behavior of any individual causes offense, danger, damage or distress to others we reserve the right at all times to cancel the booking. The company will be under no obligation to cover expenses incurred and will not consider or accept any claims for compensation, refunds, deposits or reimbursements of any lost hotel accommodation.

BEHAVIOR WITHIN YOUR ACCOMMODATION

Each hotel in resorts is now obliged to give you a list of rules and what is unacceptable from guests on arrival. We don't want you to feel like your fun is restricted but a level of respect and behavior is needed when you stay within Hotel / Apartment accommodation. It's difficult to predict how strict the hotel management will be with noise levels after dark and bringing other guests back who are not residing in the hotel.

We always recommend you ask your rep on arrival as to what noise levels and certain rules are set in place at the hotel. Many Hotels/Apartments will have several hundred other guest staying in the hotel at the same time as you so if you persistently break these rules they can exercise the right to have you evicted from the hotel permanently. SunkissTravel can accept no responsibility for this, or will they be held responsible for supplying you alternative accommodation at their expense.

REPS / INDEPENDENT HOLIDAY REPRESENTATIVES / EMPLOYMENT

You accept that SunkissTravel is responsible for introducing you to an independent holiday representative on arrival. It is the responsibility of the holiday representative to help you find a job in any area of work. Your representative will offer you job assistance, job advice, job intro training and give you tips on how to approach managers in resort, he/she will let you know of any recruitment days available and any opportunities of job trials available.

SunkissTravel and the representative are not liable or responsible if you haven't been able to obtain work in resort. If you do not wish to take the job you are found, you are not obliged. Your reps responsibility is to spend most of your first week helping you to settle into the area and to answer any questions you may have. Your rep is contracted to you for a one month period and after that its down to the rep whether they help you after that time. Please note holiday reps are not directly employed by SunkissTravel, they are independent holiday representatives.

TRANSFERRING YOUR BOOKING

If you are prevented from traveling on your booking, you may transfer your booking to another person provided they meet all the requirements relating to that holiday. A transfer fee of £88/€100 will be payable, and must be paid in full at the time of change. Additional costs such as airline tickets may also be payable. Should you transfer your booking to another person, he/she will be liable for payment of the holiday price and other associated expenses.

CHANGING YOUR BOOKING

If you wish to change your trip to a different date or resort there is a two week (14 days) period immediately after your registration date when you can change this free of charge. If you change your booking more than 14 days after you register then there will be a charge of £20/€22 for changing the date or resort.

HEALTH CARE & INSURANCE

Travel & Health Insurance is required on all Working Holidays and is absolutely essential. We advise you to take both to cover all your activities on your chosen working holiday experience. Health Insurance - Make sure you 100% apply now if you haven't already for your FREE EHIC European Health Insurance Card. The EHIC card entitles you to a free medical treatment in any public hospital. Travel Insurance lets you use any of the private medical centers in resort.

SunkissTravel will not be held liable for any costs incurred for medical expenses resulting in an accident, illness or injury sustained whilst working with us in the summer. We strongly advice to please 110% ensure you have adequate cover.

SUMMER WORK / JOBS

The purpose of the Holidays we arrange is to allow you to earn a living abroad. However, whether you secure employment (or even seek employment at all) is down to you. We will arrange a party introduction and other entertainment, which will give you an opportunity to meet other people living or staying in or around the resort and through which you might find out about job openings. Our resort representatives will, where practicable, also make introductions for you to local employers with whom we are connected.

One of the most frequently asked questions at SunkissTravel we receive is (Can you guarantee me a job this summer?) To the extent SunkissTravel can ensure you a job in terms of Sales positions, Event Staff, Boat Party Staff & Ticket Sellers for popular event companies in our resort locations. Ticket Sellers / Sales Positions / Event Staff / Boat Party Staff we need hundreds of Staff every season and these jobs are available to you as soon as you arrive. As you will notice from our website and social media there are many more varied roles in the resorts we offer including : PR's, Bar staff, Event Management, Waitresses, Team Leaders, Boat Party Staff, Restaurant Staff, Body Painters, Chefs, Dancers, Security, glass collectors and VIP hostesses plus much more job opportunities available in our resort locations.

At SunkissTravel its our job to help you organise interviews, job introductions and job trials. Most importantly we need you to attend trials on time, act professional as you would back home in a job environment. It’s important to be on time for work and be polite well-mannered to all managers and staff members. Your rep in resort will give you any tips/advice you need if you have an interview in resort.

All jobs in resort will require you to be outgoing and enthusiastic; this will go a long way with your team leaders, managers and the holiday tourists in resort. Our reps will assist you with job training, advice & tips in resort so you are well prepared for interviews, job trials and recruitment days. If you are searching and seek employment in any resort, it’s important you make the effort and attend all recruitment days; this gives you the chance to chat one on one with employers and job openings.

Lots of workers come out with the mind-set they are going to work but then get caught up in the holiday atmosphere and end up partying for a month. If your motivated and don't party to much your first month you will have plenty of time to party all summer long.

SunkissTravel is unable to help you with regard to any employment issues once you have accepted a job. Any complaints regarding your employer, fellow workers, or workplace should be taken up with your employer. Any complaints including those regarding being mistreated, wages payment complaints, wages, unfair dismissal and harassment complaints should be taken up with your employer or an employment lawyer. The reps are there to offer guidance and advice but it is down to the individual and their employer to resolve any disputes. Therefor complaints about the work place will not be taken further by SunkissTravel and you will be told to seek independent legal advice. SunkissTravel cannot guarantee you will like or get the jobs listed as everyone is different and has different personalities, abilities and social skills.

SunkissTravel may be able to help you obtain a visa where required. For certain countries it is necessary for us to make these arrangements through an agent online, you would authorize to do this on your behalf. It is your responsibility to ensure that the visa or clearance that you are given is appropriate to the nature of your holiday and you should do this before you travel.

PREVIOUS CUSTOMERS

If you have booked before with SunkissTravel on a working holiday. You will be entitled to a discount on any future bookings. Please note that friends that are traveling with you would not be entitled to this discount. You will be entitled to a £45/€50 discount on your booking.

TRANSFERS

Your transfer is not included in the price of your working holiday, once you have booked your place online you will get more information on how to book your transfer. Transfer must be booked 72 hours before you arrive. We recommend booking with www.resorthoppa.com

COMPLAINTS

If there is a problem during your holiday you must report it at first instance to your representative in resort by email who will take appropriate action. If it is still unresolved you must report it immediately to our office so that prompt and immediate efforts can be made to resolved the problem. You must notify us of the problem before you have booked your flight home, so we have the opportunity to resolve any problems you may have with the hotel, roommates or rep. If a complaint is made after your holiday we may not be able to take any further action and this will affect any claims for refunds or compensation.

SunkissTravel will not be able to take any responsibility for any complaints regarding accommodation noise or disturbance. You can speak to your rep in resort for advice and support but it would not be there responsibility that you have an undisturbed night's sleep. Please speak immediately with your landlord/ night manager / reception of the hotel / apartment, as they are in control of noise levels at night time.

All are resorts are based in lively resort locations so there maybe noise levels you are not used to. Any complaints regarding noise will not be taken further and you will be told to speak to your landlord / apartment / hotel reception. The representatives will try assist you as much as they can, but it is not there responsibility.

CUSTOMER SUPPORT TEAM

To enable us to offer you efficient and professional services, we are committed to ongoing training, part of which sometimes involves the recording of Telephone calls.

OUR COMMITMENT

All information supplied to SunkissTravel by its members is treated in the strictest confidence and is subject to the Data Protection Act. We promise to provide you with the best possible service, however certain holidays may only operate if minimum numbers are attained and we therefore have the right to cancel your booking if that minimum number is not achieved. It is, however, unlikely that we will have to make any changes to your working holiday as plans are made months in advance. We do however, reserve the right to make changes at any time should the need arise.

BEYOND OUR CONTROL

As per our terms and conditions we will not pay any compensation, reimburse expenses, or cover losses for any amount or otherwise accept responsibility if we have to change your Package after booking, or we, or our suppliers, cannot supply your Package, or you suffer any loss or damage of any description, as a result of circumstances beyond our control.

When we refer to circumstances beyond our control, we mean any event that we, or the supplier in question, could not foresee or avoid, even after taking all reasonable care. Such circumstances will usually include, but are not limited to, war, terrorist activity, civil unrest, industrial dispute, bad weather and significant building work outside your accommodation, which is not known to us in advance of your departure date and building work from a third party.

DISCOUNTS

If you are booking in a group of more than 5 people, we can offer the party leader a 50% discount on there entire working holiday price. There is also discounts for anyone booking a holiday with a group size of 10 or more, please contact our office for a discount price and more information. If you refer a friend to us and they book on the site you are entitled to £25/€28 Discount on your working holiday.

SEASON APT PAYMENTS

On our site we offer the option to book a season apt for the full summer season.

Please note that the booking deposit is non-refundable in all circumstances.

We accept your plans can change as a result you may need to cancel your booking.

We will give you a refund on the following basis.

If you have paid £150/€170 off your balance or less no refund will be given. Any payment over £150/€170, you will be refunded 50% of the extra amount e.g. £200/€230 is paid, you will receive 50% of the £50/€60 extra payment, giving you a refund of £25/€30 in total.

If you cancel less that 60 days prior to your original departure date no refund will be given.

If it becomes necessary for us to cancel your accommodation booking, we will refund all the money that you’ve paid to us.

All refunds requests are subject to a £25 Administration Fee charge. Any cancellations of your season apt are subject to a £25 Administration Fee charge.

Date changes are not allowed to be made if your arrival date is within 8 weeks of your request. If you change your date and then unable to come you are not entitled to apply for a refund. Unless otherwise agreed with the office.

Please note, on season apt bookings you must leave a deposit in resort to your landlord on arrival, your deposit back to you will be subject to no damages and not breaking your contract.

HOLIDAY ACCOMMODATION PAYMENTS

On our site we accept bookings for 1 week Accommodation offers in a selection of resorts.

Please note that the booking deposit is non-refundable in all circumstances.

We accept your holiday plans can change as a result you may need to cancel your accommodation booking.

We will give you a refund on the following basis.

If you have paid £150/€170 off your balance or less no refund will be given.

Any payment over £150/€170, you will be refunded 50% of the extra amount e.g. £200/€230 is paid, you will receive 50% of the £50/€60 extra payment, giving you a refund of £25/€30 in total.

If you cancel less that 60 days prior to your original departure date no refund will be given.

If it becomes necessary for us to cancel your accommodation booking, we will refund all the money that you’ve paid to us.

All refunds requests are subject to a £25 Administration Fee charge. Any cancellations of your holiday are subject to a £25 Administration Fee charge.

Date changes are not allowed to be made if your arrival date is within 8 weeks of your request. If you change your date and then unable to come you are not entitled to apply for a refund. Unless otherwise agreed with the office.

Your accommodation will ask for a security deposit on arrival and will be refunded to you if there is no damages at the end of your stay.

CANCELLATION POLICY

Your plans can change and as a result you may have to cancel your working holiday.

Due to the nature of the hotel and tourism industry every time we receive a payment from you we will pass this on to the hotelier so we can pay off your accommodation place as soon as possible. We as a company also have payment deadlines to make on your behalf. We are not a travel agency and the the accommodation we offer will not be supplied to you by a third party. It is accommodation we have rented and which we are going to sub let to you.

Accordingly, it’s not a matter of us simply contacting the landlord in question to cancel your accommodation. We would have to find somebody else to rent it to or we will be significantly out of pocket.

So if you need to cancel, please let us know as soon as possible.

Please note that the booking deposit is non-refundable in all circumstances.

We will give you a refund on the following basis.

If you have paid £200/€230 off your balance or less no refund will be given.

Any payment over £200/€230, you will be refunded 50% of the extra amount e.g. £350/€340 is paid, you will receive 50% of the £150/€170 extra payment, giving you a refund of £75/€85 in total.

If you cancel less that 60 days prior to your original departure date no refund will be given.

If it becomes necessary for us to cancel your working holiday, we will refund all the money that you’ve paid to us.

All refunds requests are subject to a £50 Administration Fee charge. Any cancellations of your working holiday are subject to a £50 Administration Fee charge.

Date changes are not allowed to be made if your arrival date is within 8 weeks of your request. If you change your date and then unable to come you are not entitled to apply for a refund. Unless otherwise agreed with the office. Please only book with us if you are serious about working abroad.

NO CANCELLATION FEES WILL BE WAIVED AS A RESULT OF :

Injury or sickness.

Delayed, rescheduled or missed flights.

Climatic, social or political problems.

Buyer Remorse.

Pandemics, Epidemics, Bird flu, Swine flu, SARS, Leprosy, Shingles, Pink eye, Rickets or Chaffed lips. However, you may be able to have any cancellation fees refunded by your Travel Insurance company, subject to their terms.

Please note that registration fees are non-refundable in all circumstances.

IMPORTANT

SunkissTravel cannot accept liability or pay compensation if a holiday is cancelled or if changes to your holiday due to war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disasters, fire or adverse weather conditions or any other reasons out of our control. We ask all clients to purchase adequate insurance to cover them for such eventualities.

SunkissTravel uses all reasonable endeavors to ensure that introductions to members seeking introductions for roommates fall within the category of persons specified by them on their application form, it will not accept responsibility if, through no fault of its' own, any such person introduced does not fall within such category.

We strongly advise that if you are uncertain of anything you have read in our terms and conditions, please contact a member of our team before registering.

MARKETING

SunkissTravel will never sell personal information. Our employees are obliged by us to respect confidentiality. We will not use your information, or the information provided by you regarding friends or others in your party, for any purpose other than carrying out your booking or, provided you have requested it, to inform you of offers in the future.

By applying to work abroad with SunkissTravel you agree to be bound by our terms and conditions and that acceptance of your application by SunkissTravel will create a legally binding contract between SunkissTravel and yourself.
